New York State Department of Financial Services The New York State Department of Financial Services (NYDFS) is an agency of the Government of New York. The New York State Department of Financial Services is charged with regulating many financial and insurance-related industries in New York State. History The New York State Department of Financial Services was created in 2010 by legislation that amended the Executive Law of New York. Legal jurisdiction and authority The New York State Department of Financial Services regulates most entities within the following sectors: insurance, banking, mortgage lending and securities. It does not regulate tax preparers, individual investment advisers, real estate agents, most small businesses, and most nonprofit organizations. The DFS falls under the Division of the New York State Department of Financial Services within the Executive Branch of the State of New York. Divisions The agency is organized into the following divisions: Division of Financial Crimes Enforcement – investigates, regulates and litigates financial crime. Division of Banking Supervision – regulates the state's banking industry. Division of Financial Policy and Planning – regulates the insurance industry. Division of Securities – regulates all securities and investment advisers in New York. The DFS also operates a Division of Market Oversight that has two offices: Division of Consumer Protection - investigates, litigates and enforces laws protecting customers of licensed financial entities. Division of Consumer Financial Protection - oversees compliance with New York State consumer protection laws.
